Product Overview:

Consented plans may specify a product brand that is not easily available, in this situation it may be possible to use a product substitute. This will involve the builder going through a simple process called a ‘minor variation request’ with their building consent authority (BCA).

What is a Minor Variation?

A minor variation is defined in the Building (Minor Variation) Regulation 2009 which forms part of the Building Act 2004: A minor variation is a minor modification, addition, or variation to a building consent that does not deviate significantly from the plans and specifications to which the building consent relates.

(1A) The substitution of a comparable product is a minor variation if —

a. The product achieves an equivalent level of performance, having regard to its design, installation, intended use, and maintenance; and
b. It is not likely to affect the compliance of other parts of the building work with the building code; and
c. The consequences of a building failure due to the product substitution would not be significantly worse than a building failure caused by the failure of the original product.

Below is a step-by-step guide on how a builder prepares a minor variation request:

  1. The builder identifies the need for substitution
  • Product availability
  • Discontinued material
  • Cost efficiency
  • Improved performance or durability
  1. The builder checks application and design
  2. Confirming the substitution meets or exceeds original specification and does not affect consent conditions, structure or warranties. IBuilt can help the builder by liaising with the designer or engineer to assist with product approval confirmation.

  1. IBuilt or a building supply merchant provides supporting IBuilt product documents to the builder:
  • Product data sheets
  • Technical specifications
  • Compliance certificates (if applicable)

  1. The builder obtains written approval from the:
  • Client
  • Designer / Architect (if required)
  • Engineer (if applicable)
  1. The builder presents a Minor Variation Request form and IBuilt product documents to the building inspector.
